We, CloudMoyo, Inc. and its affiliates and subsidiaries (“CloudMoyo”, “we”, “our” and “us”) are the owners of the website www.cloudmoyo.com (“Website”). The Website showcases CloudMoyo’s services which include contract lifecycle management services, application integration, data engineering, data management and other services (“Offerings”).

We are committed to protecting your privacy and providing you with a safe online experience. This Privacy Policy (“Privacy Policy”) covers the collection, use and disclosure of personal information collected through the Website. This Privacy Policy also applies, where relevant, to CloudMoyo Offerings made available through third-party marketplaces, including Microsoft Azure Marketplace and Microsoft Marketplace. When you access, purchase, subscribe to, trial, deploy, or otherwise interact with our marketplace-listed Offerings, certain marketplace-related information may be collected or processed by the applicable marketplace operator and/or shared with CloudMoyo for product activation, provisioning, administration, support, security, billing, compliance, and customer relationship management purposes.

1. Collection of your Personal Information

Depending on the context in which you interact with us, CloudMoyo may collect or receive personally identifiable information, such as your e-mail address, name, mobile or telephone number.

We may collect your Personal Information in the following ways:

Personal Information collected when you contact us:

We may collect your Personal Information from you when you contact us or write to us on our email address. When you contact us, we collect your full name, email address, location and any other information you provide us.

Personal Information collected for recruitment purposes:

We may collect your Personal Information when you apply for a job at our Company through the careers page on our Website. When you apply for a job through our Website, we may collect your full name, email address, place of residence, phone number, previous experience, educational details, CV/resume and any other information you share with us.

Social media platforms:

We may also collect, store and use your Personal Information when you access social media pages operated by us on Facebook, YouTube, Instagram, Twitter, and/or LinkedIn.

Personal Information collected through third-party marketplaces:

CloudMoyo may make certain Offerings available through third-party marketplaces, including Microsoft Azure Marketplace and Microsoft Marketplace. When you acquire, subscribe to, access, trial, deploy, or otherwise interact with such marketplace-listed Offerings, the marketplace operator may collect and process information about you, your organization, your marketplace account, subscription, billing transaction, marketplace usage, and related contact or administrative details in accordance with its own privacy statement, terms, and applicable policies.

CloudMoyo may receive limited information from the marketplace operator, your organization, or your authorized users in connection with your use of our marketplace-listed Offerings. This information may include business contact details, organization name, work email address, phone number, role or designation, tenant identifiers, subscription identifiers, entitlement or order information, billing or transaction metadata, product activation details, support contact details, and other information necessary to activate, provide, manage, secure, support, bill, audit, or improve the applicable Offering.

Depending on the nature and configuration of the specific marketplace-listed product or service, the product may or may not collect, store, or process Personal Information from end users. However, even where a product does not store end-user Personal Information, CloudMoyo may process limited business contact, subscription, tenant, support, billing, administrative, security, or operational information for the purposes described in this Privacy Policy.

Where a specific marketplace-listed product or service processes additional categories of Personal Information, such processing may be further described in the applicable product documentation, marketplace offer listing, agreement, data processing addendum, statement of work, or product-specific privacy notice, as applicable.

2. Accuracy of Information

The User undertakes that they shall be solely responsible for the accuracy, correctness, or truthfulness of the Personal Information shared with us whether of its own or any third party. In the event the User is sharing any Personal Information on behalf of a third person, the User represents and warrants that they have the necessary authority to share such Personal Information with the Company, obtained a written consent from such third party and the Company shall not be responsible for verifying the same. The User understands and acknowledges that such Personal Information shall be subject to the terms and conditions of this Privacy Policy.

3. Use of your Personal Information

We use the Personal Information for the following purposes:

  • to inform you about our Offerings and to respond to your requests;
  • for creation or development of business intelligence or data analytics in relation to the Offerings provided by us, for this purpose we may share the Personal Information with certain software or tools available online;
  • to provide you with a better experience when you access our Website and to improve the Offerings;

  • to manage subscriptions, entitlements, tenant or account identifiers, marketplace transactions, customer communications, service requests, support cases, and related operational requirements for marketplace-listed Offerings;
  • to comply with marketplace operator requirements, applicable contractual obligations, legal obligations, audit requirements, tax, accounting, security, fraud prevention, and compliance obligations related to marketplace transactions or product usage.

4. Information sharing

We will share your Personal Information with third parties only in the ways that are described in this privacy policy. CloudMoyo does not sell, rent or lease its customer lists to third parties without your prior consent.

Affiliates:

We may provide your Personal Information to our affiliates to enable them to improve the Offerings, provide feedback and respond to their queries.

Service Providers:

We may share your Personal Information with the service providers who work with us in connection with operating the Website and/ or providing the Offerings. All such service providers are subject to stringent confidentiality restrictions consistent with this Privacy Policy.

Third-party marketplaces:

Where CloudMoyo makes its Offerings available through third-party marketplaces, including Microsoft Azure Marketplace and Microsoft Marketplace, we may receive information from, and share limited information with, the applicable marketplace operator as necessary to enable listing, acquisition, subscription, trial, license management, activation, provisioning, billing, transaction management, customer support, reporting, compliance, security, and administration of the relevant Offering. Such marketplace operators may also independently collect and process information in accordance with their own privacy statements, terms, and policies.

Merger or Acquisition:

We may transfer your Personal Information if we are acquired by another entity, or if we merge with another company or transfer a part of our business, including the Website, to a third party. Any such third party or resultant entity that receives your Personal Information shall have the right to continue to use your Personal Information in line with the purposes set out herein. In the event of such a sale or transfer, we may notify you.

Legal and Regulatory Authorities:

We may disclose your Personal Information in order to comply with our legal obligations/ court orders/ requests by Govt. authorities.

5. Data Retention

We will retain User’s Personal Information as long as it is required to be retained for the purpose of provision of the Offerings. For marketplace-listed Offerings, CloudMoyo may retain marketplace-related information, including business contact details, subscription identifiers, tenant identifiers, entitlement information, billing or transaction metadata, support records, security logs, and operational records, for as long as necessary to provide, administer, support, secure, bill, audit, and comply with legal, contractual, accounting, tax, and regulatory obligations related to such Offerings. We may also retain and use User’s Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Upon a reasonable request, we will delete your Personal Information within a reasonable time, however, there might be delays in deleting this Personal Information from all our servers and back-ups. 6. Security of your personal information

Your Personal Information is stored on cloud infrastructure provided by third party cloud service providers. The security of your Personal Information is very important to us. CloudMoyo puts measures in place to secure your Personal Information from unauthorized access, use or disclosure. We follow generally accepted standards to protect the Personal Information submitted to us, both during transmission and once we receive it. Although we provide appropriate firewalls and protections, we cannot guarantee the security of Personal Information transmitted as these systems are not hack proof. Data pilferage due to unauthorized hacking, virus attacks, technical issues is possible, and we will take necessary measures to mitigate such events.

7. Your Rights

You have the right to access Personal Information in our possession, right to have us rectify or modify any such Personal Information, right to have us erase/delete your Personal Information, right to restrict us from processing such Personal Information, right to object to our use of Personal Information, withdraw consent at any time where we are relying on consent to process Personal Information. Depending on the nature of the request, we may ask you to complete a Personal Information request form or seek certain details to verify the request. 9. Information for EU and UK Visitors

Residents of the European Union (“EU”) and United Kingdom (“UK”) should note that this Privacy Policy has been updated in accordance with the requirements of the EU General Data Protection Regulation (the “GDPR”) and the UK GDPR, the United Kingdom Data Protection Act 2018, the Privacy and Electronic Communications Regulations, and any regulation superseding any of the foregoing (“UK Privacy Laws”). As per the provisions of the GDPR and UK Privacy Laws we shall be considered the Controllers of the Personal information collected as a result of your use / access of the Website and Processors of the Personal information collected as a result of your use / access of the Services. Depending on the nature of a marketplace-listed Offering and the applicable contractual arrangement, CloudMoyo may act as a Controller or Processor with respect to certain marketplace-related or product-related Personal Information. Additional role-specific terms may be set out in the applicable product documentation, agreement, data processing addendum, statement of work, or product-specific privacy notice.

Legal Basis for EU residents and UK residents:

We will not process your Personal Information without a lawful basis to do so. We will process your Personal Information only on the legal bases of consent, contract, or on the basis of our legitimate interests, provided that such interests are not overridden by your privacy rights and interests. For marketplace-listed Offerings, the legal basis may include performance of a contract, compliance with legal obligations, legitimate interests in providing, securing, supporting, administering, billing, auditing, and improving the Offering, or consent where required by applicable law.

Transfer of your personal information across borders for EU Residents:

The Personal Information we collect of EU and UK residents is stored on servers located in the EU region. Personal Information might be processed outside the EU and UK. You have the right to request us:

  • right to restrict us from processing such Personal Information;

  • you have the right to lodge a complaint with a data protection authority.

UK residents have the right to make a complaint at any time to the Information Commissioner’s Office (“ICO”), the UK supervisory authority for data protection issues, www.ico.org.uk. Governing Laws:

For any EU and UK residents, this Privacy Policy shall be governed respectively by the provisions of the GDPR and UK Privacy Laws.

This Privacy Policy shall in all respects be governed by and construed and enforced in accordance with the laws of Washington.

Our Website may contain links to other websites/ platforms of your interest. Please note that we do not have any control over such other websites/ platforms, and you will be accessing such websites, platforms, and applications at your own risk. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such websites and platforms and those are not governed by this Privacy Policy. You should exercise caution and look at the privacy policy applicable to such websites/ platforms.

Your use of third-party marketplaces may be subject to the marketplace operator’s own privacy statement, terms of use, marketplace terms, billing terms, and data processing practices. CloudMoyo does not control the independent privacy or data processing practices of such third-party marketplace operators.

12. Product-Specific Notices

Certain CloudMoyo Offerings, including marketplace-listed products or services, may have additional product-specific privacy notices, documentation, agreements, data processing terms, statements of work, or marketplace offer descriptions. In the event of any product-specific processing of Personal Information that differs from or supplements this Privacy Policy, the applicable product documentation, agreement, marketplace listing, data processing addendum, statement of work, or product-specific privacy notice will provide additional information.

13. Updates to privacy policy

This Policy may be amended from time to time, consistent with applicable data protection and privacy laws and principles. We will notify you of changes to this Policy through email, or other means. We will notify customers if we make changes that materially affect the way we handle Personal Information that we previously collected, and we will allow them to choose whether their Personal Information may be used in any materially different manner.
